Terms & Conditions
Article 1. Who we are
1.1 These General Terms & Conditions (the "Terms") are issued by Margot Visser, sole proprietor (eenmanszaak) trading as STORIESbyM. She also operates under the brand names Margot Visser, The ReBelle Sessions, Maison ReBelle and any other brand or programme she launches now or in future (together "STORIESbyM", "we", "us" or "our").
1.2 Business details: registered trade name STORIESbyM, Chamber of Commerce (KvK) number 91017351, VAT number NL004860017B33, business address Rhodoniet 5, 4762 CS Zevenbergen, the Netherlands, email margot@margotvisser.com.
1.3 STORIESbyM is the trade name of Margot Visser's sole proprietorship, so Margot Visser is the sole contracting party. Brand names (including "Margot Visser" as a brand), programme names and team members do not form separate legal entities and do not contract in their own name.
Article 2. Definitions
2.1 Client ("you"): the person or business who buys or uses a Service.
2.2 Business Client: a Client who acts for the purposes of her trade, business, craft or profession.
2.3 Private Client: a Client who is a natural person acting outside her trade, business, craft or profession (a consumer under Dutch law).
2.4 Services: everything we offer, including programmes, masterminds, group and 1:1 coaching, mentoring, workshops, live and recorded calls, online courses, workbooks, audio trainings, digital products, community and chat groups (including Telegram), events and retreats, whether online or in person.
2.5 Programme: a Service delivered over a set period, such as Maison ReBelle.
2.6 Materials: all content we provide or create in the Services, including workbooks, videos, audio, recordings, templates, frameworks, methods, slides, exercises and written feedback.
2.7 Agreement: the contract between you and us for a Service, made up of the offer or sales page, the order or booking confirmation and these Terms.
2.8 Programme Fee: the full price of a Service, whether paid in one payment or in instalments.
Article 3. Scope and how these Terms apply
3.1 These Terms apply to every offer, quote, order, booking and Agreement between you and us, and to every Service we deliver, unless we agree otherwise in writing.
3.2 If a specific offer, sales page or event booking form contains additional terms, those additional terms apply alongside these Terms. If they conflict, the specific terms take priority for that Service only.
3.3 We do not accept any terms or conditions of the Client, unless we explicitly agree to them in writing.
3.4 By ticking the acceptance box at checkout, signing an offer, making a payment or accessing a Service, you confirm that you have received, read and accepted these Terms.
3.5 If any provision of these Terms is void or annulled, the rest remains in force. We will replace that provision with a valid one that comes as close as possible to its original purpose.
3.6 We may update these Terms. The version that applies to your Agreement is the version you accepted when you bought, unless you agree to a later version.
3.7 Where these Terms say "in writing", email counts.
Article 4. Offers and how the Agreement is made
4.1 Offers, sales pages and prices are without obligation. Obvious errors or typos do not bind us.
4.2 The Agreement is made when you complete checkout, sign an offer, or make a first payment, whichever comes first. You will receive a confirmation by email.
4.3 We may decline any application or order without giving reasons, including when we believe a Service is not the right fit for you.
4.4 Your place in a Service is personal. You may not share, transfer or resell your access, log-in details, calls or Materials to anyone else without our written consent.
4.5 By buying, you confirm that you are at least 18 years old and legally able to enter into the Agreement.
4.6 By buying with a business name, KvK number or VAT number, or for the purpose of building or growing your business, you confirm that you buy as a Business Client.
Article 5. Prices and payment
5.1 Prices are in euros. Prices for Business Clients exclude VAT unless stated otherwise. Prices shown to Private Clients include VAT.
5.2 Payment is due in full before the start of the Service, unless you choose a payment plan we offer.
5.3 Payment plans. A payment plan is a way of paying the full Programme Fee in instalments. It is not a monthly subscription. By choosing a payment plan you commit to paying every instalment, also if you stop using the Service, miss calls, or end your participation early.
5.4 You authorise us and our payment provider to collect instalments automatically on the agreed dates. You make sure your payment method stays valid.
5.5 Late payment. If a payment fails or is late, we will notify you and you have 14 days to pay. If you still have not paid:
-
we may pause your access to the Service, calls, community and Materials until payment is received, without this reducing the amount you owe;
-
the full remaining Programme Fee becomes immediately due;
-
Business Clients owe statutory commercial interest (art. 6:119a Dutch Civil Code) and collection costs; Private Clients owe statutory interest (art. 6:119 Dutch Civil Code) and collection costs within the limits of Dutch law.
5.6 Chargebacks. Do not dispute or reverse a payment you owe under the Agreement. If you do, the amount, plus any costs we incur, remains due and we may end your access immediately.
5.7 We may change our prices at any time. A price change does not affect a Service you have already bought.
Article 6. Duration of Programmes
6.1 Each Programme runs for the term stated in the offer. Maison ReBelle has a minimum term of 6 months, starting on the date stated in your confirmation.
6.2 After the minimum term, your membership continues month to month at the then-current monthly fee, unless you or we cancel it in writing with one month's notice. If you prefer to continue on a longer term (for example 12 months), we confirm this in writing.
6.3 Private Clients can cancel a continued membership at any time with one month's notice.
6.4 We may make reasonable changes to the content, schedule, format, platforms, number of calls or guest contributors of a Programme, as long as the overall value of the Programme stays comparable.
Article 7. Cancellation and refunds
7.1 No refunds. Subject to Articles 7.6 and 7.7 for Private Clients, our Services involve reserved places in small groups, our time and immediate access to Materials. All payments are therefore non-refundable, and the full Programme Fee remains due, once the Agreement is made. This applies whether or not you attend, use the Materials or complete the Programme.
7.2 Business Clients. Business Clients may not end the Agreement early. The right to terminate a service agreement at any time (art. 7:408 Dutch Civil Code) is excluded, and so is any right to dissolve or annul the Agreement on grounds other than our proven serious failure to perform.
7.3 1:1 sessions. You can reschedule a 1:1 session once, up to 48 hours before it starts. Sessions cancelled later or missed are forfeited. Sessions not used within the term of the Agreement expire. If we need to reschedule, we offer a new time.
7.4 Group calls. Missed group calls are not refunded or repeated. Where calls are recorded, you can watch the recording.
7.5 Pausing. We may, at our sole discretion, allow you to pause a Programme for personal reasons. A pause does not reduce or postpone your payment obligations unless we confirm otherwise in writing.
7.6 Private Clients: right of withdrawal. If you are a Private Client buying online, you have a 14-day right of withdrawal, with these exceptions:
-
Digital content (such as workbooks, courses, recordings and The ReBelle Sessions materials): you ask for immediate access and acknowledge that you lose your right of withdrawal once access is given.
-
Services that start within 14 days: you ask us to start early. If you then withdraw, you pay a proportionate amount for what was delivered up to that moment. If the Service has been fully delivered, you have no right of withdrawal.
To withdraw, send us an email within the 14 days. We refund what is owed within 14 days of receiving it.
7.7 Private Clients: early termination. A Private Client may end a Programme early in writing. You then pay for the Services delivered up to the end date, plus a reasonable compensation for the place we reserved for you and costs we cannot recover, set at 25% of the remaining Programme Fee.
Article 8. Nature of the Services
8.1 Our Services are coaching, mentoring, strategy and education. We commit to delivering them with care and to the best of our ability. This is an obligation of effort, not an obligation to achieve a specific result.
8.2 We share perspectives, tools, methods and feedback. You decide what to do with them. Every decision about your business, brand, content, offers, pricing, money, relationships and life is yours, and so are its consequences.
8.3 We may use assistants, team members, guest experts or other professionals to deliver parts of a Service. Art. 7:404 Dutch Civil Code (personal performance) does not apply.
Article 9. No guarantees
9.1 We do not guarantee any result, including income, revenue, clients, followers, visibility, launch outcomes, confidence or personal transformation.
9.2 Results shared by us or by other clients, in testimonials, case studies, posts or calls, are examples of what individuals achieved. They are not typical, not a promise and not a prediction of your results. Your results depend on factors outside our control, including your effort, skills, market, timing, circumstances and choices.
9.3 Any figures, projections or examples we use are illustrations only.
Article 10. Not therapy, medical, legal or financial advice
10.1 Our work covers identity, mindset, nervous system awareness and brand strategy. It is educational and coaching in nature. It is not psychotherapy, psychological or psychiatric treatment, counselling, medical care, or legal, tax, financial or investment advice, and it is not a substitute for any of these.
10.2 We are not licensed medical or mental health professionals. We do not diagnose, treat or cure any condition.
10.3 If you are receiving or need medical or psychological care, you remain responsible for seeking and continuing it. Consult your doctor or therapist before joining if you are unsure whether a Service is right for you. Tell us beforehand if something might affect your safe participation.
10.4 Visualisations, breathwork, body-based or reflective exercises are always voluntary. You participate at your own discretion and risk, listen to your own body and limits, and stop whenever you need to.
10.5 You are responsible for your own physical, mental and emotional wellbeing during and after the Services. If we believe a Service is not appropriate for you at a given moment, we may pause your participation or refer you to another professional.
10.6 For legal, tax, accounting or financial decisions, consult a qualified professional.
Article 11. Your responsibilities
11.1 You give us accurate and complete information that is relevant to the Service.
11.2 You show up for scheduled calls, complete the work you choose to do, and take responsibility for your own progress.
11.3 You make sure you have the equipment, internet connection and apps needed to take part (such as Zoom and Telegram).
11.4 You are responsible for your own business, including what you publish, sell, promise and charge, and for complying with laws and regulations that apply to it.
11.5 You make sure that anything you share with us or the group (including content, images or information about other people) does not infringe anyone's rights.
Article 12. Conduct and community
12.1 Our groups are built on trust. You treat other members, guests and our team with respect, and you do not harass, discriminate, shame or intimidate anyone.
12.2 You do not pitch, sell, recruit or promote your own or anyone else's services to other members inside the Services or through contact details obtained there, unless they ask you to.
12.3 You do not record, screenshot, copy or share calls, chats or posts of other members.
12.4 If you breach this Article, we may give you a warning, or suspend or end your access immediately. In that case the full Programme Fee remains due and no refund is given.
12.5 Community and call platforms (such as Telegram, Zoom and course platforms) are run by third parties. We are not responsible for their availability, security or changes, and may move to another platform when needed.
Article 13. Events and retreats
13.1 In-person events and retreats may have their own booking terms. Those apply alongside these Terms.
13.2 Unless the event offer states otherwise, the event fee covers the programme and the elements listed in the offer. You arrange and pay for your own travel, transfers, travel documents and anything not listed.
13.3 Insurance. You must have valid health insurance, travel insurance and cancellation insurance for the full duration of the event, including travel.
13.4 Cancellation by you. Event fees are non-refundable. You may transfer your place to another person, subject to our written approval and that person accepting these Terms. Private Clients have no right of withdrawal for leisure services booked for a specific date (art. 6:230p Dutch Civil Code).
13.5 Cancellation or changes by us. We may change the venue, programme, schedule or facilitators if necessary, keeping the experience comparable. If we cancel an event, we refund the event fee you paid us, or offer a place at another event if you prefer. We are not liable for any other costs, including travel, accommodation, visas or time off.
13.6 Health and safety. You tell us before the event about any health condition, allergy, pregnancy, medication or limitation that could affect your safe participation. Physical activities, outdoor activities, swimming, walks and use of venue facilities are at your own risk. You follow the instructions of the venue and our team.
13.7 Conduct. You are responsible for your behaviour, including alcohol use. We may remove you from an event without refund if your behaviour puts anyone at risk or seriously disturbs the group. You bear any costs of leaving early.
13.8 Third parties. Venues, caterers, transport companies and other suppliers are independent. We are not liable for their acts, omissions, services or facilities.
13.9 Belongings and damage. We are not responsible for loss, theft or damage to your belongings. You are liable for damage you cause to the venue or other people's property.
13.10 We may take photos and video at events. You can tell us at the start that you do not want to be recognisably shown, and we will respect that.
Article 14. Recordings
14.1 Group calls may be recorded and shared with members of that Service for the duration of their access. By joining, you consent to being recorded. You can turn your camera off or change your display name if you prefer not to be seen.
14.2 Recordings of 1:1 sessions are shared only with you, unless we agree otherwise in writing.
14.3 We will not use recordings in which you can be identified for marketing or public purposes without your separate written consent.
14.4 Recordings are our property and fall under Article 16.
Article 15. Testimonials and feedback
15.1 We may ask you for feedback or a testimonial. Giving one is voluntary.
15.2 We only publish a testimonial, your name, photo, business name, results or screenshots of your messages with your written consent, given on our testimonial consent form or in writing.
15.3 We may shorten a testimonial or correct spelling, without changing its meaning.
15.4 You can withdraw your consent for future use at any time. We then stop using it in new materials and remove it from our website and channels within a reasonable time. Material already printed, sent or shared cannot be recalled.
15.5 Your testimonial must reflect your honest experience. If we offer anything in return for a testimonial, we disclose this.
Article 16. Intellectual property and confidentiality
16.1 All intellectual property rights in the Services and Materials, including our methods, frameworks, programme names, brand names, trademarks and recordings, belong to Margot Visser or her licensors.
16.2 You receive a personal, non-exclusive, non-transferable licence to use the Materials for your own business and personal development for as long as you have access.
16.3 Without our written consent you may not copy, share, publish, sell, teach, translate, adapt, upload into AI tools for training purposes, or use the Materials or our methods to create a competing programme, course, product or service.
16.4 Your own brand, content, offers and work that you create during the Services remain yours.
16.5 Access to online Materials ends when your Programme ends, unless the offer states otherwise. We recommend downloading anything you want to keep for your own use.
16.6 Our confidentiality. We keep confidential everything you share with us in the Services, unless you give us permission, the information is already public, or we are required by law to share it or need to share it to prevent serious harm to you or others. We may use general, anonymised insights from our work to improve our Services and content.
16.7 Your confidentiality. You keep confidential everything other members share in the Services, including their identity, business details, stories and struggles.
16.8 This Article continues to apply after the Agreement ends. If you breach Article 16.3 or 16.7, you owe us an immediately payable penalty of EUR 5,000 per breach plus EUR 500 for every day the breach continues, without affecting our right to full damages. This penalty does not apply to Private Clients.
Article 17. Liability
17.1 We are only liable for direct damage that results from a failure attributable to us in performing the Agreement.
17.2 We are not liable for indirect or consequential damage, including lost profit, lost revenue, missed clients or opportunities, reputational damage, business interruption or emotional distress.
17.3 Our total liability is limited to the amount our professional liability insurer pays out in the case concerned. If the insurer pays nothing, our total liability is limited to the fees you paid for the Service concerned in the 6 months before the event causing the damage, with a maximum of EUR 5,000.
17.4 We are not liable for damage caused by: your decisions or actions based on the Services; incorrect or incomplete information you gave us; your participation in exercises, activities or events against our instructions or your own limits; third parties, including venues, suppliers, guest experts and platforms; or technical failures, data loss or outages of software and platforms.
17.5 Before we can be in default, you must notify us in writing, describe the failure precisely and give us a reasonable period to fix it.
17.6 You must report any claim in writing within 30 days of discovering it. Business Clients' claims expire one year after the event causing the damage.
17.7 The limitations in this Article do not apply to damage caused by our intent or deliberate recklessness. For Private Clients, they apply only as far as Dutch law permits.
17.8 Everyone who works with or for us in delivering the Services can rely on this Article as if they were party to the Agreement.
Article 18. Indemnity
18.1 You indemnify us against all third-party claims, and the costs connected with them, that result from your breach of these Terms, your use of the Materials, your conduct during the Services or events, or the business, content and services you offer.
Article 19. Force majeure
19.1 We are not obliged to perform, and not liable, if we are prevented from doing so by circumstances beyond our reasonable control. These include illness or a serious family emergency affecting Margot Visser, outages of internet, power or platforms, government measures, pandemics, extreme weather, natural disasters, strikes, war and travel disruption.
19.2 In that case we may postpone the affected part of the Service, deliver it in another format (for example online instead of in person), or have it delivered by a qualified replacement.
19.3 If force majeure lasts longer than three months, either party may end the Agreement in writing for the part not yet delivered. We then refund what you paid for that part, minus costs we cannot recover. No other compensation is owed.
Article 20. Termination by us
20.1 We may suspend or end your access and the Agreement with immediate effect, without notice of default, if you: fail to pay on time (after the 14 days in Article 5.5); breach Article 12 or 16; act in a way that harms the group, our team or our reputation; or are declared bankrupt or granted a suspension of payments.
20.2 In those cases you remain liable for the full Programme Fee and for any damage we suffer. No refund is given.
20.3 We may also end a Service for any other reason in writing. We then refund the part of the fee that relates to the Services not yet delivered, and nothing more.
Article 21. Privacy
21.1 We process your personal data in line with the General Data Protection Regulation (GDPR) and our privacy policy at [link].
21.2 In community platforms such as Telegram, other members may see your name, profile and, depending on your settings, phone number. Check your platform privacy settings before joining.
Article 22. Complaints, governing law and disputes
22.1 If you have a complaint, email us at [email] with a clear description. We respond within 14 days and aim to find a solution together.
22.2 These Terms and all Agreements are governed by Dutch law. The Vienna Sales Convention (CISG) does not apply.
22.3 Disputes are submitted exclusively to the competent court in the district of [Margot's business address, e.g. Rechtbank Amsterdam].
22.4 If you are a Private Client living in another country, you keep the protection of the mandatory consumer laws of your country of residence, and you may also bring a claim before the courts there.
